Google Orders Cease and Desist of CyanogenMod

Android and Me reported that popular Android platform modder Cyanogen has received an official cease and desist order from Google. He is best known for improving the "Google Experience" on Android based devices, with over 30,000 active users. The order apparently deals directly with his distribution of their closed source apps, such as GMail, Maps, Talk, etc.. In fact, as of the writing of this article, the site CyanogenMod.com is currently offline. If this is the end of the road for this popular developer, it could net some major backlash for Google.

Check out the full article here.

I remember when something like that happened with Sony and PSP developer Dark Alex. The biggest difference there was most of what Dark Alex was doing was technically illegal.

As long as Cyanogen doesn't distribute the closed source apps, then he shouldn't have a problem I believe. Android itself is an open source system so not much they can control.

That's the problem, he is re-distributing them as part of the modded Android OS. That's what's ticking Google off, but if he's not modding those or selling them, I'm not sure why they're so upset.

Iono. Is the modded version under the same restrictions as the original? For example is it open source as well?

The modded OS itself is legal because it's open-source, but it's sent out just like the un-modded with the closed-source apps.

Hmm maybe its a license issue to. If its GPL then technically it couldn't be redistributed based on that alone. That's probably Google's case.

    Google threatens Cyanogen with C&D

I just got word of this in the morning and could not believe the nerve of Google..... all i got to say is read this article.

This is a weird one: Google has just slapped Cyanogen, maker of the biggest and most successful Android ROM mod around, with a cease-and-desist letter. But Google's reasoning doesn't make any sense, and we're wondering what their game is.

See, Google's cease-and-desist specifically states that Cyanogen should stop passing around Google's closed-source apps like Google Maps, Google Talk and Gmail, because those are only supposed to be used on Google Experience Android devices like the G1 and MyTouch 3G. That makes sense, except for one thing: Cyanogen only works on the exact devices those closed-source apps were designed for, like, well, the G1 and MyTouch 3G. So what's the point of trying to stop Cyanogen?

Engadget suggests that maybe Google just wants to discourage rooting of their devices in general, which seems awfully contrary to the Android open-source philosophy. Truth is, we have no idea why Google would want to stop a thriving and well-received modder, but Cyanogen says he's trying to open up some communication with the big G, so hopefully we'll get an explanation soon. [Android and Me via Engadget]

Like I said above I believe its a licensing issue. With the new info from the post above, I would also say maybe they are worried that it can introduce vulnerabilities when related to their apps.

The Android platform itself is open-source, but the addons such as Google Maps, Talk, etc. are not and that's what Google is talking about in the order. Technically Cyanogen isn't licensed to redistribute those apps and he contends that if he can't release those with the mod, the mod itself won't be usable as they are tied in heavily with the OS itself.
