    I agree also. Even as addictive as the BB is, there is still a level of personal responsibility that has to be held for one self.

    I always like the people who think they're safe because they only use they're cell when stopped. While that maybe SAFER, it isn't what you should be doing.

    While you're on the road there are two things you should be doing at all times:

    1: make sure you do not hit anyone.
    2: make sure no one is going to hit you.

    By looking at your BB while stopped, you are no longer doing number 2.

    I just have one question...how is BB responsible for when and how their customers use their services? That's like suing the alcohol company because a drunk driver caused an accident. I strongly disagree.

    I blame the jury for the stupid award and I hope that when it is appealed it will be nullified or at least reduced to 110k or less. The plaintiff had a good attorney and a stupid jury. A jury with any intelligence would place the blame on the actions of the driver and not the device at which he was looking.
    In today's society no one wants to take responsibility and always blames someone else (or a device like a BB) for their actions. And too many juries are made of people that also are not willing to take responsibilty for their own actions and find it easy to blame a company (or a device) for the actions of some negligent individual while the reality is the individual is totally at fault.
    And after it is all said and done and the verdict is in the lawyers make more money than the victims...

    Well, this is just like that story of the guy who bought the Winnebago, and put it on cruise control, went to the back to make a sandwhich, of course he crashed b/c no one was at the wheel, and a jury awarded him a ton of money and a new winnebago..lol. The reason the award: the owners manual didn't specifically say that you couldn't set the cruise control and walk away from the drivers seat. Now they do.

    This happened in suburban Chicago. I'm not sure what the cell phone laws are there but in Chicago the law is something along the lines of 'you can't be driving while on the phone without proper use of a headet or speakerphone'. I think even holding a cell phone (to look at or send texts) might fall into this as well.
