    I tried today and nothing they said all they have is refurb's and nothing they could do. I am having the peeling problem along with dust under the screen. I had had plenty of problems with warranty exchange in the past I will give it a few days and call back and complain again

    Hey Guys,
    Sorry that you all are having so much trouble getting AT&T to work this out.
    When I got my 8310, I had the escalation rep/supervisor transfer me to customer care and the lady there ordered the new phone for me. She was very sorry for the problems I was having (which I feel were a lot less than what I've herd from you folks) and that she wanted to fix the situation. I kept a cool head and spoke authoritatively, but in a very respectful way, about wanting a new phone. She said she could order me a replacement phone at no charge and even a new SIM just to make sure I didn't have any problems there. When I asked her which "color" the phone would be she said Silver. I then said I really wanted the Red one. She said she didn't think there were any lift in the system but that she would double check if I didn't mind holding on. I didn't mind one bit! She got back and appologized for taking so long (only took 3 min.) and that she found the the Red one and it's on it's way to me. This was on Sunday afternoon and I got my phone on Wed.

    This is very similar to what happened to me. I was on with warranty who told me it would be a refurb. I asked for an escalation rep. Once he got on the phone, he told me there was nothing he could do, but that he would get me to CS and a supv over there. Once on with that supv I remained calm, but stern. He apologized for all of the inconvenience and said he would send me a new 8310 in red at no cost. Next day a titanium one arrived. I called back, spoke to a supv and explained it was supposed to be red. He said he would send the correct one and to send the titanium one back. Low and behold, red one arrived next day. Not that it matters, but I have been with ATT for about 5 years, and my average bill is about $140 a month after discounts.

    Good to here that you were served well by AT&T. I have found that we have to just be persistent in getting what we desire from them, in a nice way of coarse. Sometimes you can get a cs rep who is just having an off day and doesn't put in the required work to satisfy all our concerns. You never know, they could have been on the phone all day with cranky customers who yell and cuss them. We all never have days like that, right. I'm sure some of them don't even like the job they have.

    If we are patient and kind we can give them some sense of relief to there long day and then they can be more helpful in the end.

    But we must keep trying!

    Just got off the phone with att...they told me the peeling is not cover under the warranty..it will cost me $349..to get an exchange becuz it's considered a cold damage...plus i've been having alotta technical problems with the phone it'self. 1)It's been doing a master reset on it's own..deleting everything..my )whole life..hehehe..2)takes days for it to charge up if i let it drain out..3) it wont let me reply any of my emails or compose email. 4)takes like 2-3mins for it to turn on. I told this to the CS rep data dept. she was speechless and said it was at my own discrepancy to make the exchange..but will prolly have to pay the $349 for the peeling which the fee is non disbutable. she couldnt assist me with the tech problems..wtf i am not paying another $349 again..might as well get a new phone..okay..anywase i have a headache rite now..just thinking about it.

    Don't get me wrong RIM has made some good strides with the consumer friendly BB's. But mixing the rubber with plastic is not a good look with the peeling. I had four swap outs for 8300's. I was tired. The 8310 is going to peel as well because that top rubber piece is plastic still covered with thin rubber as the 8300 is. I spent literally hours on the phone with ATT. They actually said that I was the first person to complain about this. Yeah right!!! They got tired of me and they upgraded me to a brand new 8820 for the inconvienence. I will not look back because this phone is incredible. Buyers beware of the 8300 series.If you can deal with the peeling its a fine device. But if your like me and try to keep your devices looking right it is not the device for you. Trust me. I HAD FOUR OF THEM.

    well finally after 2 replacements i am getting an 8310 titanium brand new from warranty now i have 4 chargers, 4 usb cables, 4 batteries and 4 headset

    I totally understand the concept of warranty exchange, but why don't they do anything if you lose your phone since they don't offer insurance on the thing? I recently lost my 8300, and was basically told I'd have to pay the full price to get a new one because I am in the middle of my contract. I think the stranglehold the cell companies have is ridiculous - why does the damn thing cost $400+ to begin with?!
