All right, at least I got the thing updated to 4.5. Anyway, found a post on a blackberry site saying to call the carrier and request the "subsidy unlock code" and they said that I could not get the unlock code if I wasn't a customer or if I did not know anybody on t-mobile. Ugh.

Here's what I'd do... I'd call the seller and let them know that the phone is locked and therefore is a breach of ebay contract since they misinformed you... Request them politely to unlock it for you... If they refuse assistance, then you can file a complaint against them to ebay... That will get ebay to jump in to try and moderate a resolution...

I've done that exact process before...

Yeah, I messaged the seller but I was able to get an unlock code for $3.75 on eBay.
