    Ok you all have probably seen from my comments in the past that I am most definitely not a loyal Apple fan
    So looking at this from the outside my initial impression would be here we go again, Photoshop making things look more like Apple products and this is not good. When the Samsung is made smaller it looks the same as the Iphone, this may have however been done consciously to demonstrate that the design is similar (Apple could argue that Samsung made the phone larger to avoid such suits). Similarly there could be inherent software/hardware (internal) items that could infringe on specific patents, especially as Samsung make a number of Iphone/Ipad parts. Obviously Apple is unhappy enough to take it to court. I have been in a position in a company where other companies have infringed upon Patents we held and openly said it was their own, we were most definitely unhappy, it didn't go to court as there were items that could be negotiated, but when you feel that you have the intellectual property on an item and someone else uses it without giving you credit you take action.
    I never thought I would defend Apple!

    You're not defending Apple,you're just speaking logically on the topic.

    None of us have all of Apples evidence in this case, and to think that these pictures are the whole case is just demeaning to anyone's intelligence. I'm sure all devices will be present at the hearings, and everyone will notice that these phones are not the same size.

    I know some out there are loyal iPhone users. I ask you this: Has Apples credibility been damaged in your eyes?
    No. Everyone has the right to protect what is theirs, even if that means looking like a whiny child.

    Will Samsung or Googles image be damaged if they are found to be guilty of using something that isn't theirs?

    All well and good, and I would agree 100%.

    I have to wonder if Apple true ly feels that their designs have been infringed upon, and here's why.

    If you felt that there were copyright issues AND you felt that the product should be banned, then I would guess you would head off to court with clear and solid evidence. After all, you employ copyright attorneys for just such a thing. If you are going to stand up, ask for a ban, then I would guess said lawyers, CEO, COO, and anyone else in charge would be certain the case had some merit.

    If it has merit, why try and manipulate photos of your competitions product? To preserve your credibility with the courts and your customers you wouldn't. This is the second time this has been reported, clearly its not an accident. Right now I wouldn't trust Apple as far as I could throw them.

    Perhaps not all the evidence, but if their case is so strong why do this twice? Touchwiz doesn't remind me at all of the iPhone. Hell, should every company head off to court whenever someone uses a rectangular slab of glass that has a touch screen, rings, goes online, etc. And that's what this is about. Apple knows damn well that there are devices out that can give it a run for its money in the eyes of the general consumer, and it bugs the hell out of them. Instead of behaving like a responsible company and competing, they head off to court to try and ban a product.

    Defending a patent does not, and should ever, require doctoring photos IN TWO cases. If anyone wants to pretend mighty Apple is defending intellectual property, they're fooling themselves. It's about fear, fear of competition, fear of losing market share, and losing their precious flock of iSheep.

    In addition I will offer up this pages comparison. Pay special attention to the last image. Indeed, following Apples thinking, who should sue who.

    So in your eyes it's OK to steal others ideas and profit off of someone else's hard work? Let Apple pay for all the research and development, take what works, and make something similar, and bank off of the success. Where in that state of mind do you find what you call a "responsible company"?

    Like I said, the devices will be there so everyone can hold them and they can judge for themselves. These pics were just examples. To think that Apple is trying make everyone think that these devices are the same size is pretty damn stupid.

    What hard work is stolen? Don't tell me is icons, because I'd wonder why apple isn't knocking on every theme developers door who receives money for a theme that uses iPhone icons.

    Don't tell me design, because I'll ask you why they haven't gone after every other manufacturer that makes a rectangular slab of glass. Oh, that's right, their dimensions are different. Until Apple Image Specialists get a old of them any way.

    Don't tell me internals. Snap dragons and nvidia chips aren't the same as the A5. Hell every iPhone user is more than happy to tell you that.

    Don't tell me screen. Nothing compares to the (smaller) iPhone screen. Another "fact" that iPhone fans love to tout.

    Don't tell me user expirience. Raise your hand if you've stated just how smooth the iOS is compared to Android. Not to mention that neither look alike, unless you're going to court that is.

    So what hard work? What (in this lawsuit) hard work and research has been "stolen". If you can tell me that, then tell me why the need to doctor images?

    ...as you can see, Samsung tried to pass this inferior object on the masses as an iPhone equivalent. It is not. Note the similar bezels, the icons that almost think that your looking at an Apple device, but clearly comes up short, the similar shape of phones is quite the same, but lacks the "magic" that only Steve Jobs can deliver. Don't let Samsung fool you by making this phone a tad bigger. Samsung knew that their screen, while a good screen, was not clear, and sharp enough to compete with the iPhone, they had to make it bigger, I mean, how else would you be able to read what icons are which in that lagfest.

    Ladies and Gentleman, I know most of you think that Apple is afraid of the success of Android, and some people want you to believe that Androids success and market share is based on the greatness of Android. It's not. How many phones do you think Android could sell in Bogo's and 2 year contracts with a subsidized $50 phone? How many phones do you think you can sell by telling a T-mobile customer that "this phone right here is almost like an iPhone"? Millions ladies and gentleman, millions.

    I'd still buy exhibit "A", jailbreak it and have my pics display in HD Retina view and enjoy other companies trying hard to make something similar and compensate by release low-res 45 inch screen cellphones....I love it. ethugging to the mac.

    Hmm none of us are lawyers, at least I am not, but I think there are some pretty good arguments on both sides written above. I am pretty surprised by the number of patent cases coming to light at the moment. So is Apple right taking this to court? Is this the only way Apple can compete, I thought Apple had a good product which should be able to hold its own. This is going to be interesting

    Nothing to watch. Went from "are they credible" to essentially "ends justify the means" (even though there's no evidence Samsung copied Apple) to the usual "my iPhone is better than your [inesert any device that was produced with Jobs Magic] device".

    Apple continually runs to court crying foul. That's fine and dandy until they start doctoring evidence used in their claims. What amuses me personally is how loyal fans are oh so quick to point out how superior (they are?) the user expirience is, yet get up in arms when its threatened, to the point of defending what appears to be evidence tampering. I'm willing to bet that wouldn't be tolerated if any other company did it to Apple.

    My point all along isn't that one device is better than the other. It is simply that it astounds me that iFans can ignore the low level Apple will go to when it feels threatened. Look at the Galaxy Tab images, changing images, showing the app drawers (in both cases implying that's where the user begins) and so on.

    Yet all this is just OK. Because Apple says they've been copied, then its so. Court need not apply?

    I'm taking my dog out of this fight. I'm not doing the device pissing match.

    Somehow I thought Pinstack was better than that.
